Official Contest Rules
The Xplore Connected Year Contest (the “Contest”) is sponsored by Xplore Inc. (the “Sponsor”).
The Contest consists of contest periods (each, a “Contest Period”). Each Contest Period begins at 12:00 a.m. ET on the 19th calendar day of a month and ends at 11:59 p.m. ET on the 18th calendar day of the following month.
The Contest is open to individuals who meet ALL of the following criteria at the time of entry:
are legal residents of Canada;
have reached the age of majority in their province or territory of residence at the time of entry;
are existing residential customers of Xplore Internet with an active account in good standing prior to the first day of the Contest Period; and
are not employees, officers, directors, agents, contractors, service providers, and authorized representatives (including immediate family members and members of the same household) of the Sponsor or any of the Sponsor’s affiliates, subsidiaries, authorized dealers, advertising and promotional agencies, prize suppliers, and any other person or entity associated with the Contest.
4.1 Referral Entry. During each Contest Period, an eligible entrant must submit a referral of a prospective new Xplore residential Internet customer using the method designated by Xplore (each, a “Referral Submission”). A Referral Submission is valid if it is submitted in compliance with the method, form and requirements specified by Xplore and contains all required information of the referred individual (a “Valid Referral Submission”). Each Valid Referral Submission earns the entrant one (1) entry into the applicable Contest Period prize draw, regardless of whether the referred individual subscribes to, purchases, installs, or activates Xplore Internet service. Multiple referrals of the same prospective customer by the same entrant will be counted as one (1) Valid Referral Submission only.
5. QUALIFYING REFERRAL AND BILL CREDIT.
A “Qualifying Referral” occurs when a referred individual, as a direct result of the entrant’s Valid Referral Submission, satisfies all of the requirements for a qualifying referral set out in the reward policy for Xplore’s Refer-a-Friend program, as posted at https://www.xplore.ca/shop/refer-a-friend (the “Program Reward policy”).
Upon confirmation of a Qualifying Referral in accordance with the Program Reward Rules, the referring entrant will receive a one-time bill credit (the “Bill Credit”), applied to their Xplore account. The amount of the Bill Credit (the “Bill Credit Amount”) is determined by the Sponsor in its sole discretion and may vary from one Contest Period to another. The Bill Credit Amount applicable to a Qualifying Referral is the Bill Credit Amount that was in effect for the Contest Period during which the corresponding Valid Referral Submission was made. Before the start of each Contest Period, the Sponsor will publish the Bill Credit Amount applicable to that Contest Period on its website (or through such other means as the Sponsor may designate), and that published Bill Credit Amount will remain fixed for the duration of that Contest Period. The Bill Credit is not redeemable for cash and is subject to the terms and conditions of the entrant’s service agreement with Xplore. Bill credits are independent of and in addition to any entries earned for the prize draw.
For clarity, a Valid Referral Submission entitles the entrant to one (1) entry in the prize draw whether or not the referred individual completes a Qualifying Referral. The Bill Credit, in the Bill Credit Amount applicable to the relevant Contest Period as determined under this section, is awarded only for a Qualifying Referral.
For each Contest Period there is one (1) prize available to be won consisting of payment of the winner's current Xplore residential Internet access charges and standard equipment rental charges for a period of one (1) year, applied as a credit to the winner's existing Xplore Internet account for twelve (12) consecutive monthly billing cycles following prize fulfilment. The credit amount for each billing cycle will be equal to the sum of the winner's current monthly Internet access charges and equipment rental charges (i.e., the recurring charge for Internet access service and the recurring standard equipment rental fee) at the time of prize fulfilment, and will not include any installation charges , add-ons, or other fees billed on the winner’s account. To the extent that any federal, provincial, or municipal taxes apply to the prize or any portion thereof, the winner is solely responsible for the payment of such taxes. If the winner terminates their Internet service before the end of the twelve (12) month period, any credits for the remaining months will be cancelled and no substitute prize or cash equivalent will be provided. Upon expiry of the twelve (12) month prize period, the winner's Internet service will continue at the then-current price and the winner will be responsible for all payments associated with their Internet service thereafter.
The approximate retail value (“ARV”) of the prize will vary depending on the winner's current monthly Internet access charges and standard equipment rental charges at the time of prize fulfilment. Based on Xplore's current residential Internet service pricing, the ARV of each prize is estimated to be between $780 CAD and $1,800 CAD (calculated as twelve (12) months of the winner's monthly Internet access charges and standard equipment rental charges only, exclusive of installation charges, taxes and any other fees). The actual value of the prize may differ at the time of prize fulfilment depending on the winner's selected Internet service plan, equipment, and applicable pricing. No difference between the stated ARV and the actual value of the prize will be awarded in any form.
The prize is not redeemable for cash and has no cash surrender value. The prize is non-transferable and must be accepted as awarded. No substitution is permitted except at the Sponsor’s sole discretion. If the winner cancels their Xplore internet account during the prize period, any remaining credit will be forfeited.
Each individual is eligible to win only one (1) prize under this Contest, regardless of the number of Contest Periods in which such individual enters or the number of eligible entries submitted.
The odds of winning depend on the total number of eligible entries received during the applicable Contest Period. All eligible entries (both referral entries and mail-in entries) have an equal chance of being selected.
On or about the 7th business day following the close of each Contest Period, a random draw will be conducted by the Sponsor from among all eligible entries received during the applicable Contest Period.
Before being declared a winner, the selected entrant must correctly answer, without assistance of any kind, a time-limited mathematical skill-testing question administered by telephone, email, or as part of the prize claim process.
10. WINNER NOTIFICATION AND VERIFICATION.
The potential winner will be notified by telephone and/or email within 3 business days of the draw. The potential winner must respond to the notification within 3 business days of receipt and must:
correctly answer the skill-testing question;
sign and return a declaration and release form (“Release Form”) confirming compliance with these Official Rules, acceptance of the prize as awarded, and release of the Sponsor and its agents from any and all liability in connection with the Contest and the prize, and except where prohibited by law, permit the Sponsor to publish, reproduce and/or use his or her name, address (city and province), voice, photograph or other likeness, without further notice or compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor; and
provide any additional information or documentation reasonably required by the Sponsor to verify eligibility.
If the potential winner cannot be reached within the specified timeframe, fails to correctly answer the skill-testing question, fails to return the required documentation within the time stipulated by the Contest Sponsor, is found to be ineligible, or otherwise fails to comply with these Official Rules, the potential winner will be disqualified and the prize will be forfeited. In such event, the Sponsor reserves the right, in its sole discretion, to select an alternate winner by random draw from the remaining eligible entries for the applicable Contest Period.
11. GENERAL
By entering the Contest, entrants agree to abide by these Official Rules, and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process or the operation of the Contest or acting in violation of these Official Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. The Sponsor is not liable for injuries, death, damages or losses of any kind resulting from participation in the Contest or acceptance or use of the prize. In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" means the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
12. PRIVACY AND PERSONAL INFORMATION.
By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of Xplore Inc. which is located at https://www.xplore.ca/policies/privacy-policy/. Any inquiry concerning the personal information held by Xplore Inc. should be addressed to Xplore Inc. at 625 Cochrane Drive, Suite 1000, Markham, ON L3R 9R9.
13. PUBLICITY.
The name of the prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed Release Form as set out above.
14. SUBJECT TO APPLICABLE LAWS.
This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations, and is void where prohibited.
